{"id":5603,"date":"2014-07-28T09:41:15","date_gmt":"2014-07-28T08:41:15","guid":{"rendered":"http:\/\/www.solucominsight.fr\/?p=5603"},"modified":"2015-02-04T16:50:14","modified_gmt":"2015-02-04T15:50:14","slug":"du-nouveau-statut-stagiaires-risques-opportunites","status":"publish","type":"post","link":"https:\/\/www.riskinsight-wavestone.com\/en\/2014\/07\/du-nouveau-statut-stagiaires-risques-opportunites\/","title":{"rendered":"Du nouveau dans le statut des stagiaires : entre risques et opportunit\u00e9s"},"content":{"rendered":"<p><i style=\"line-height: 1.5em;\">La <a href=\"http:\/\/www.assemblee-nationale.fr\/14\/dossiers\/developpement_encadrement_stages.asp\">loi relative au \u00a0d\u00e9veloppement et \u00e0 l&#8217;encadrement des stages<\/a> a \u00e9t\u00e9 promulgu\u00e9e par le Pr\u00e9sident de la R\u00e9publique le 10 juillet 2014. Cette loi poursuit un double objectif\u00a0: r\u00e9affirmer que le stage doit\u00a0\u00eatre un outil \u00e0 part enti\u00e8re au service du cursus de formation et mieux prot\u00e9ger les droits des stagiaires.<\/i><\/p>\n<p><i>Focus sur les <\/i><i>trois mesures phares de cette loi et sur leurs principaux impacts pour les stagiaires\u2026et les entreprises.<\/i><\/p>\n<h2>Une dur\u00e9e plafonn\u00e9e \u00e0 6 mois<\/h2>\n<p>La limitation portera la dur\u00e9e maximale des stages \u00e0 six mois. Une exception sera cependant possible pour les cursus qui n\u00e9cessitent une dur\u00e9e d&#8217;insertion professionnelle sup\u00e9rieure en lien avec les professions vis\u00e9es. Ces formations figureront sur une liste arr\u00eat\u00e9e par d\u00e9cret. Ce d\u00e9cret s\u2019appliquera pendant les deux ann\u00e9es qui suivront la promulgation de la loi. Il ne sera ensuite plus possible, pour un \u00e9tudiant, de rester plus de six mois en stage au sein d&#8217;une m\u00eame entreprise.<\/p>\n<p>Les \u00e9tablissements d&#8217;enseignement pourront valider un stage qui aurait \u00e9t\u00e9 interrompu avant son terme\u00a0; y compris en cas de rupture de la convention \u00e0 l&#8217;initiative de l&#8217;entreprise. Cette mesure vise \u00e0 ne plus p\u00e9naliser le jeune dans son parcours.<\/p>\n<p>Cette limitation aurait une cons\u00e9quence double. On peut s\u2019attendre \u00e0 une <b>recrudescence des<a title=\"solucomINSIGHT - R\u00e9forme de la formation professionnelle, de l\u2019emploi et de la d\u00e9mocratie sociale, quelles nouveaut\u00e9s sur le plan RH ? Zoom sur l\u2019apprentissage.\" href=\"http:\/\/www.solucominsight.fr\/2014\/03\/reforme-formation-professionnelle-lemploi-democratie-sociale-quelles-nouveautes-plan-rh-zoom-lapprentissage\/\"> formations en alternance<\/a><\/b>. Pour les jeunes qui souhaitent accro\u00eetre leur exp\u00e9rience professionnelle durant leur formation, cette mesure peut favoriser leur r\u00e9orientation vers des cursus en alternance.<\/p>\n<p>Cela signifie aussi <b>la fin du recours \u00e0 l\u2019ann\u00e9e de c\u00e9sure<\/b> pour les jeunes qui interrompaient momentan\u00e9ment leur formation pour exercer une activit\u00e9 visant exclusivement l&#8217;acquisition de comp\u00e9tences en liaison avec cette formation.<\/p>\n<h2>Augmentation de la gratification des stagiaires<\/h2>\n<p>La gratification reste obligatoire pour tout stage dont la dur\u00e9e d\u00e9passe deux mois dans l\u2019entreprise.\u00a0\u00c0 compter du 1<sup>er<\/sup> septembre, son montant minimum passera de 436 euros \u00e0 523 euros mensuel. Pour mettre en \u0153uvre cette hausse qui s\u2019\u00e9l\u00e8ve \u00e0 87 euros, un d\u00e9cret \u00e0 venir devrait pr\u00e9voir une augmentation en deux temps : + 43,50 euros \u00e0 la rentr\u00e9e 2014 et + 43,50 euros \u00e0 celle de 2015. Cependant, un d\u00e9cret fixera les conditions d\u2019abaissement de cette gratification, dans le cadre de formations dispens\u00e9es dans le milieu rural et agricole.<\/p>\n<p>Le montant de cette nouvelle gratification sera fixe quel que soit le nombre de jours ouvr\u00e9s dans le mois. Ceci afin d&#8217;\u00e9viter que les entreprises ne d\u00e9falquent les \u00e9ventuels jours f\u00e9ri\u00e9s ch\u00f4m\u00e9s intervenant durant le mois consid\u00e9r\u00e9.<\/p>\n<h2>De nouveaux droits pour les stagiaires<\/h2>\n<p>La loi dote les stagiaires de nouveaux droits. Droit \u00e0 des <b>titres restaurant<\/b> ou <b>acc\u00e8s au restaurant d\u2019entreprise<\/b> tout d\u2019abord. Si une entreprise dispose d&#8217;un restaurant, elle devra en assurer l&#8217;acc\u00e8s au stagiaire. \u00c0 d\u00e9faut, le stagiaire devra avoir droit \u00e0 des titres restaurant, au m\u00eame titre que les autres collaborateurs de l\u2019entreprise.<\/p>\n<p>Le stagiaire aura \u00e9galement droit \u00e0 la <b>prise en charge partielle des frais de transports<\/b>. L&#8217;employeur sera tenu de prendre en charge une part du prix des titres d&#8217;abonnements souscrits par le stagiaire pour ses d\u00e9placements entre sa r\u00e9sidence habituelle et le lieu de son stage. Les modalit\u00e9s fines d\u2019application seront pr\u00e9cis\u00e9es par d\u00e9cret.<\/p>\n<p>Enfin, droit \u00e0 des <b>cong\u00e9s en cas de grossesse, de paternit\u00e9 ou d\u2019adoption<\/b> avec une dur\u00e9e \u00e9quivalente d&#8217;absence \u00e0 celle pr\u00e9vue pour les autres salari\u00e9s.<\/p>\n<p>Ces dispositions induisent donc une augmentation du pouvoir d\u2019achat des stagiaires mais surtout une augmentation du co\u00fbt des stages pour les entreprises. Une augmentation qui\u00a0 peut, sur le long terme, inciter ces derni\u00e8res \u00e0 r\u00e9duire le recours \u00e0 cette population.<\/p>\n<p>Pour d\u2019avantage encadrer un secteur qui a connu des abus et des d\u00e9boires ces derni\u00e8res ann\u00e9es, le choix a \u00e9t\u00e9 fait d\u2019augmenter les co\u00fbts et de complexifier les r\u00e8gles des stages en entreprise. Pour beaucoup de jeunes adultes, ces stages repr\u00e9sentent le premier vrai contact avec le monde professionnel. Ceci est l\u2019occasion pour eux de mettre un pied dans la vie active. Pour les entreprises, les stages sont un moyen d\u2019avoir acc\u00e8s \u00e0 une main d\u2019\u0153uvre suppl\u00e9mentaire, dans des conditions moins contraignantes et co\u00fbteuses que les contrats \u00e0 dur\u00e9e d\u00e9termin\u00e9e ou d\u2019int\u00e9rim. Laissons-nous quelques mois pour conna\u00eetre les r\u00e9els impacts de cette loi.
