Ce rapport propose des recommandations au Congr\u00e8s am\u00e9ricain pour encadrer ces transactions. Quelles sont ces orientations\u00a0? Sont-elles nouvelles ou dans la m\u00eame ligne directrice que le projet de r\u00e8glement europ\u00e9en\u00a0?<\/i><\/p>\n<h2>Une l\u00e9gislation \u00ab\u00a0permissive\u00a0\u00bb aux \u00c9tats-Unis, une opportunit\u00e9 pour les data brokers<\/h2>\n<p>Les data brokers sont des agences de courtage des donn\u00e9es qui collectent des informations personnelles d\u2019internautes (noms, adresses, hobbies, donn\u00e9es de sant\u00e9, etc.) provenant de sources multiples (r\u00e9seaux sociaux, administrations publiques, sources commerciales, \u2026). Ces informations sont analys\u00e9es et servent \u00e0 la construction de profils et de cat\u00e9gories. Elles sont ensuite revendues sous la forme de produits \u00e0 des fins, par exemple, de marketing, de recherche sur les personnes ou de lutte contre la fraude. On estime qu\u2019il existe <a href=\"http:\/\/www.worldprivacyforum.org\/2013\/12\/testimony-what-information-do-data-brokers-have-on-consumers\/\" target=\"_blank\" rel=\"noopener noreferrer\">4000 data brokers<\/a> aux \u00c9tats-Unis (<a href=\"http:\/\/www.acxiom.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Acxiom<\/a>, <a href=\"http:\/\/www.corelogic.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Corelogic<\/a>\u2026), chacun pouvant d\u00e9tenir plusieurs centaines de milliards de donn\u00e9es\u00a0! Un march\u00e9 qui ne cesse d\u2019augmenter, \u00e0 l\u2019\u00e8re du Big Data et de l\u2019explosion des donn\u00e9es en circulation. Un march\u00e9 qui doit son essor au cadre l\u00e9gislatif sp\u00e9cifique au continent am\u00e9ricain.<\/p>\n<p>En effet, il n\u2019existe pas de loi g\u00e9n\u00e9rale aux \u00c9tats-Unis concernant les donn\u00e9es \u00e0 caract\u00e8re personnel (DCP). L\u2019approche am\u00e9ricaine se caract\u00e9rise au contraire par des dispositifs sp\u00e9cifiques pour chaque secteur ou domaine. Par exemple, le Privacy Act pour le secteur public ou encore le Gramm-Leach-Bliley Act pour les institutions financi\u00e8res. Certains principes pr\u00e9sents sont connus en Europe comme la garantie de s\u00e9curit\u00e9 des donn\u00e9es collect\u00e9es, la notification en cas de vol de donn\u00e9es et la d\u00e9signation d\u2019un responsable de traitement. Cependant dans ces l\u00e9gislations, m\u00eame au niveau f\u00e9d\u00e9ral, de nombreux principes comme la finalit\u00e9 de traitement, le droit \u00e0 l\u2019information ou le droit \u00e0 la rectification tels que nous les connaissons, sont absents.<b><br \/>\n<\/b><\/p>\n<h2>Une amorce de prise de conscience pour une l\u00e9gislation renforc\u00e9e aux \u00c9tats-Unis\u2026<\/h2>\n<p><b>\u00a0<\/b>La <a href=\"http:\/\/www.ftc.gov\/\" target=\"_blank\" rel=\"noopener noreferrer\"><i>FTC<\/i><\/a> s\u2019est pench\u00e9e sur la question de ce vide juridique vis-\u00e0-vis des data brokers et a livr\u00e9 ses recommandations dans un rapport publi\u00e9 en Mai 2014. L\u2019autorit\u00e9 pr\u00e9conise des dispositions l\u00e9gislatives, d\u00e9j\u00e0 pr\u00e9sentes dans les diff\u00e9rentes r\u00e9glementations en Europe, comme le droit de rectification, le droit d\u2019opposition, le droit \u00e0 l\u2019information et le droit d\u2019acc\u00e8s. En outre, la FTC recommande aux data brokers de prendre des pr\u00e9cautions pour renoncer \u00e0 la collecte d\u2019informations relatives \u00e0 des mineurs ainsi que de consid\u00e9rer les enjeux de la vie priv\u00e9e dans toutes les \u00e9tapes du traitement des donn\u00e9es\u00a0: c\u2019est le principe du \u00ab\u00a0Privacy by Design\u00a0\u00bb\u00a0(on retrouve d\u2019ailleurs ces deux notions dans le projet de <a href=\"http:\/\/www.elections2014.eu\/fr\/news-room\/content\/20140307IPR38204\/html\/Des-r%C3%A8gles-plus-strictes-pour-prot%C3%A9ger-la-vie-priv%C3%A9e-%C3%A0-l'%C3%A8re-num%C3%A9rique\" target=\"_blank\" rel=\"noopener noreferrer\">futur r\u00e8glement europ\u00e9en<\/a>). Ce rapport a permis de mettre sur le devant de la sc\u00e8ne le sujet des donn\u00e9es personnelles aux \u00c9tats-Unis. Cette tendance risque certainement de s\u2019amplifier avec <a href=\"http:\/\/www.justice.gov\/opa\/pr\/2014\/June\/14-ag-668.html\" target=\"_blank\" rel=\"noopener noreferrer\">le discours du minist\u00e8re de la Justice de l\u2019administration Obama du 25 juin dernier<\/a> qui s\u2019est engag\u00e9 \u00e0 l\u00e9gif\u00e9rer plus largement sur la protection des donn\u00e9es personnelles.<b><br \/>\n<\/b><\/p>\n<h2>Avant les \u00c9tats-Unis, d\u2019autres pays ont l\u00e9gif\u00e9r\u00e9\u2026 avec difficult\u00e9<\/h2>\n<p><b>\u00a0<\/b>De nombreux pays ont r\u00e9cemment tent\u00e9 de l\u00e9gif\u00e9rer dans ce \u00a0sens, \u00a0en s\u2019inspirant plus ou moins fortement des principes europ\u00e9ens. C\u2019est le cas de Singapour (le Personal Data Protection Act est entr\u00e9 en vigueur le 2 juillet dernier), de l\u2019Inde (2013), du Br\u00e9sil (2014), ainsi que de nombreux pays d\u2019Afrique comme le Maroc (2009), le Gabon (2011), le Mali (2012) ou le Kenya (2014). Tous ont connu des difficult\u00e9s pour imposer des mesures contraignantes de respect des DCP et pour installer durablement une autorit\u00e9 de contr\u00f4le ind\u00e9pendante. Cette tendance montre cependant l\u2019int\u00e9r\u00eat croissant des pays \u00ab\u00a0dits\u00a0\u00bb \u00e9mergents pour ce sujet qui n\u2019est plus uniquement une question europ\u00e9enne.<\/p>\n<h2>L\u2019Europe est-elle en passe d\u2019imposer sa vision sur le traitement des DCP\u00a0?<\/h2>\n<p>Le sujet des donn\u00e9es personnelles a pris une place de plus en plus importante en Europe et dans le monde au regard des diff\u00e9rentes l\u00e9gislations mises en place ces derni\u00e8res ann\u00e9es. Mais l\u2019\u00e9v\u00e9nement majeur de ces derniers mois reste la promesse am\u00e9ricaine de l\u00e9gif\u00e9rer plus largement sur le sujet. Promesse qui s\u2019appuie sur des principes bien connus en Europe.<br \/>\nEn cons\u00e9quence, un deuxi\u00e8me mod\u00e8le concurrent de protection des DCP vient-il s\u2019ajouter au mod\u00e8le europ\u00e9en ou l\u2019Europe est-elle en train de r\u00e9ussir \u00e0 imposer sa vision sur les donn\u00e9es personnelles face au mod\u00e8le am\u00e9ricain\u00a0?
