Pour les grandes entreprises, le d\u00e9cret du 24 septembre 2014 avance l\u2019obligation de d\u00e9marrage de la DSN au 1er avril 2015. Ces derni\u00e8res ne disposent donc plus que de 7 mois pour mettre en \u0153uvre la DSN qui constitue un projet \u00e0 part enti\u00e8re.<\/p>\n<h2>Quand la DSN devient-elle obligatoire\u00a0?<\/h2>\n<p>Le d\u00e9cret n\u00b0 2014-1082 du 24 septembre 2014 fixe deux seuils\u00a0\u00ab\u00a0<em>appr\u00e9ci\u00e9s en fonction du montant de cotisations et contributions sociales dues au titre de 2013, au-del\u00e0 desquels la mise en \u0153uvre de la DSN est obligatoire : <\/em><\/p>\n<ul>\n<li><em>2 millions d&#8217;euros pour les employeurs qui effectuent eux-m\u00eames les d\u00e9clarations ; <\/em><\/li>\n<li><em>1 million d&#8217;euros pour les employeurs ayant recours \u00e0 un tiers d\u00e9clarant, d\u00e8s lors que ce tiers d\u00e9clare pour l&#8217;ensemble de son portefeuille un montant de 10 millions d&#8217;euros<\/em> \u00bb.<\/li>\n<\/ul>\n<p>Les employeurs ne respectant pas l&#8217;obligation de D\u00e9claration Sociale Nominative s&#8217;exposeront \u00e0 des p\u00e9nalit\u00e9s\u00a0: <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do;jsessionid=E5F933A5DD0FB4E6DBF9A53349ABE9AF.tpdjo12v_3?cidTexte=LEGITEXT000006073189&amp;idArticle=LEGIARTI000006749061&amp;dateTexte=&amp;categorieLien=cid\" target=\"_blank\">L&#8217;article R.243-16 du code de la s\u00e9curit\u00e9 sociale<\/a>\u00a0pr\u00e9voit une p\u00e9nalit\u00e9 de 7,50 euros par salari\u00e9 ou assimil\u00e9. Mais le d\u00e9cret dit que \u00ab\u00a0<em>cette p\u00e9nalit\u00e9 ne peut \u00eatre sup\u00e9rieure, par entreprise et par mois, \u00e0 10 000 euros si l&#8217;entreprise emploie au moins deux mille salari\u00e9s et \u00e0 750 euros si elle emploie un nombre inf\u00e9rieur de salari\u00e9s<\/em> \u00bb.<\/p>\n<p>Pour les employeurs d\u00e9passant un de ces seuils, l\u2019obligation de d\u00e9claration par la DSN prendra effet d\u00e8s la paie d\u2019avril 2015, \u00e0 transmettre le 5 (ou le 15) mai, soit \u00e0 compter de mai 2015.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-5877\" alt=\"image DSN\" src=\"http:\/\/www.solucominsight.fr\/wp-content\/uploads\/2014\/10\/image-DSN-437x138.jpg\" width=\"437\" height=\"138\" srcset=\"https:\/\/www.riskinsight-wavestone.com\/wp-content\/uploads\/2014\/10\/image-DSN-437x138.jpg 437w, https:\/\/www.riskinsight-wavestone.com\/wp-content\/uploads\/2014\/10\/image-DSN-71x22.jpg 71w\" sizes=\"auto, (max-width: 437px) 100vw, 437px\" \/><\/p>\n<p><i>Source : Lumens Consultants \u2013 Cabinet Solucom<\/i><i><\/i><\/p>\n<h2>Les chantiers cl\u00e9s de la premi\u00e8re phase du projet DSN<strong> <\/strong><\/h2>\n<p>Le projet de mise en \u0153uvre de la DSN d\u00e9bute par le remplacement des d\u00e9clarations de la premi\u00e8re phase (attestation DMMO\/EMMO, attestation IJ, attestation p\u00f4le emploi, radiation mutuelle\/pr\u00e9voyance). M\u00eame si cette phase ne porte pas directement sur des notions de cotisations et\/ou de p\u00e9nalit\u00e9s,\u00a0il est important de ne pas la sous-estimer. 4 chantiers majeurs sont ainsi \u00e0 anticiper\u00a0:<\/p>\n<p>Tout d\u2019abord, <b>les impacts organisationnels,<\/b>\u00a0notamment pour les organisations en CSP RH. Qui sera responsable de la validation du fichier DSN\u00a0? Comment seront r\u00e9parties les activit\u00e9s de contr\u00f4le\u00a0et de correction des donn\u00e9es entre les diff\u00e9rents acteurs\u00a0: acteurs locaux et centre de gestion ? Selon quelle planification mensuelle ?<br \/>\n<b><br \/>\n<\/b>Ensuite,<b> la mise en qualit\u00e9 des donn\u00e9es<\/b> (s\u00e9lection, modification, exhaustivit\u00e9) sur des informations qui habituellement pourraient \u00eatre consid\u00e9r\u00e9es comme non-sensibles mais \u00e9galement la mise \u00e0 jour de nouvelles informations n\u00e9cessaires \u00e0 la DSN<\/p>\n<p>Mais aussi<b> l\u2019accompagnement m\u00e9tier<\/b>\u00a0et la <b>professionnalisation des acteurs<\/b> aux actes de gestion\u00a0: donn\u00e9es importantes \u00e0 renseigner, contr\u00f4les \u00e0 effectuer, processus impact\u00e9s\u2026<\/p>\n<p>Enfin,<b> les \u00ab\u00a0d\u00e9cisions sociales\u00a0\u00bb<\/b> qui doivent \u00eatre n\u00e9goci\u00e9es et conclues pr\u00e9alablement \u00e0 toute sp\u00e9cification (par exemple, n\u00e9cessit\u00e9 d\u2019aller vers la subrogation afin d\u2019\u00e9viter des flux \u00e9v\u00e9nementiels vers Net Entreprises en cas de non-subrogation des IJSS).<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Au 1er janvier 2016, la DSN (D\u00e9claration Sociale Nominative) deviendra la modalit\u00e9 unique de collecte des donn\u00e9es sociales des entreprises par les organismes et administrations.
